Terms of Service

1. About the Clinic

Beyond the Scale Clinic is a private multidisciplinary obesity medicine practice based in Mbombela, Mpumalanga, South Africa. Our team comprises a medical doctor, registered dietician, and clinical psychologist — all registered with the Health Professions Council of South Africa (HPCSA).

2. Our Services

We offer the following clinical services:

• Medical assessment, metabolic investigation, and pharmacotherapy (including GLP-1 receptor agonist protocols)
• Registered dietetic consultation and personalised medical nutrition therapy
• Clinical psychology assessment and behavioural support
• Multidisciplinary team (MDT) case reviews and integrated treatment planning
• Access to the patient portal for health tracking and document management

Services are provided through 3-month and 6-month structured packages. Individual session pricing is available on request.

3. Medical Disclaimer

The information provided through our website, patient portal, and resource library is for educational and clinical support purposes only. It does not constitute medical advice and must not replace consultation with a qualified healthcare professional.

Treatment outcomes, including weight loss results, vary from person to person. No specific result is guaranteed. Our practitioners will discuss realistic expectations with you during your initial assessment.

In the event of a medical emergency, contact emergency services (10177 / 112) immediately.

4. Patient Responsibilities

As a patient of Beyond the Scale Clinic, you agree to:

• Provide accurate, complete, and current information about your health history and medications
• Notify us promptly of any changes to your health, medications, or contact details
• Attend booked appointments, or cancel with at least 24 hours' notice
• Follow agreed treatment plans or communicate any concerns to your practitioner
• Use the patient portal only for legitimate personal healthcare purposes
• Keep your portal login credentials confidential and not share access with others

5. Appointments and Cancellations

Booking

Appointments are confirmed upon receipt of a deposit or full payment, as communicated at the time of booking. Appointments are subject to practitioner availability.

Cancellation and Rescheduling

• Cancellations made more than 24 hours before the appointment: full credit or rescheduling at no charge
• Cancellations within 24 hours: a late cancellation fee may apply (communicated at booking)
• No-shows without notice: the full consultation fee is forfeited

We reserve the right to reschedule appointments where a practitioner is unavailable due to illness or emergency. We will give as much notice as possible.

6. Fees and Payment

Fees for our service packages are communicated prior to commencement of treatment. We reserve the right to review fees with reasonable notice. All fees are quoted and payable in South African Rand (ZAR).

We do not currently contract directly with medical aids as a network provider. Accounts may be submitted for reimbursement claims at the patient's discretion, and we will provide the necessary clinical codes and documentation on request.

7. Patient Portal

The patient portal is provided to support your clinical journey. You are responsible for the accuracy of data you enter (weight logs, meal logs, symptom reports). Portal data supplements — but does not replace — clinical consultations.

We reserve the right to suspend portal access where misuse is detected, or where a patient is no longer under active care at the clinic.

8. Intellectual Property

All content on the Beyond the Scale website, including text, design, educational resources, and clinical materials, is the intellectual property of Beyond the Scale (Pty) Ltd. You may not reproduce, distribute, or commercially exploit any content without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by South African law, Beyond the Scale Clinic shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or patient portal, including but not limited to loss of data or interruption of service.

Our total liability for any claim shall not exceed the fees paid for the specific service to which the claim relates.

Nothing in these terms limits liability for gross negligence, wilful misconduct, or matters that cannot be excluded under applicable law.

10. Governing Law and Disputes

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall first be referred to good-faith mediation. If unresolved, disputes shall be subject to the jurisdiction of the Mpumalanga High Court.

Patients also retain their rights to approach the HPCSA or the National Consumer Commission where applicable.

11. Changes to These Terms

We may update these terms from time to time. Continued use of our services after notification of changes constitutes acceptance. The current version is always available on this page.
